Terms of Service

1. Agreement

By creating an account or a memorial page on EverBond, you agree to these terms. If you don't agree, please don't use the service.

2. Eligibility

You must be at least 18 years old to create an account. If you're helping a family create a memorial and you're under 18, please have a parent or guardian create the account on the family's behalf.

3. What EverBond is

EverBond lets you create a digital memorial page for a loved one — photos, life story, family members, voice recordings, and a guestbook for tributes — accessible by QR code, plaque, or direct link. A Free plan is available with limits on photos, videos, and memorial pages; a paid Plus plan removes most of those limits.

4. Your content

• You own the photos, stories, and other content you upload. You're responsible for having the right to share it.
• Don't upload content that is illegal, harassing, or that impersonates someone without authorization.
• As the memorial's owner, you're responsible for moderating guestbook messages and comments before approving them for public view.
• We may remove content that violates these terms or applicable law.

5. Payment and billing

Plus is billed monthly or yearly. Because we don't yet process card payments automatically, upgrading records your interest and our team follows up manually to arrange payment via GCash or Maya (or PayPal/card for customers abroad). You can cancel and return to the Free plan at any time — your photos and stories are kept, not deleted.

30-Day Money-Back Guarantee: if you're not satisfied within your first 30 days on Plus, we'll refund you in full. This applies once, to your first upgrade only — it does not apply to renewals or reactivations after that window.

6. Privacy controls

You decide whether a memorial is Public or Private, and who is approved to access a private one. See our Privacy Policy for how we handle personal data.

7. Data portability & what happens if EverBond shuts down

You can download a copy of a memorial's photos, videos, voice recordings, life story, family list, and tributes at any time from your dashboard — this isn't limited to a shutdown scenario.

If we ever decide to discontinue EverBond, we will notify account holders by email at least 90 days in advance and make sure this export option keeps working through that entire notice period, so you have time to save everything before the service goes offline.

8. Account termination

You may stop using EverBond at any time. We may suspend or terminate an account that violates these terms, engages in abuse, or is used fraudulently.

9. Service availability

We aim to keep EverBond available at all times but don't guarantee uninterrupted access. We're not liable for losses arising from temporary downtime, third-party service outages, or events beyond our reasonable control.

10. Limitation of liability

EverBond is provided "as is." To the extent permitted by law, we aren't liable for indirect, incidental, or consequential damages arising from your use of the service. Nothing here limits any liability that can't be limited under Philippine law.

11. Indemnification

You agree to hold EverBond harmless from claims arising out of content you upload or your violation of these terms — for example, if you post a photo you didn't have the right to share.

12. Governing law and disputes

These terms are governed by the laws of the Republic of the Philippines. Any dispute arising from these terms or your use of EverBond will be resolved in the courts of the Philippines, unless we agree otherwise in writing.

13. Changes to these terms

We may update these terms as the product changes. We'll update the date at the top of this page when we do; continued use after a change means you accept the update.
